Machmer Media: Terms and Conditions for Videography Portrait Session
Welcome to Machmer Media. Before proceeding with the videography portrait session, please carefully review the following terms and conditions:
1. Videography Portrait Session:
- The videography portrait sessions will take place on May 24th, 2025 between 10:20am and 12:00pm. There will be no makeup sessions after the aforementioned time frame.
- Participants are encouraged to sign up for a time slot at the event.
- The videography portrait session consists of a short video recording of participants posing in front of a camera. The sessions will last no longer than 5 minutes. The moving portrait videos will be no more than 30 seconds in duration.
- Each session will result in one (1) video file.
- Photography is not part of the videography portrait session.
2. Ownership and Copyright:
- All media captured by Machmer Media remains the intellectual property of the company.
- Parents / legal guardians / participants retain the right to display and use the video portraits for personal purposes only, such as personal social media profiles, personal websites, and personal printing.
3. Media Delivery, Selection, and Editing:
- Machmer Media will provide each participant with a link and access to an online gallery containing their video portraits.
- One (1) video file is included with the free session sign-up and can be downloaded from the aforementioned gallery.
- If more than one video portrait is captured, additional video files will be available for download with an additional fee (see Section 4: Payment and Pricing).
- If more than one video file is present in the provided gallery, participants will need to make a selection of the desired file included in their session or any additioanl files that will be purchased. There is no guarantee that more than one video file will be included in each gallery.
- Minor editing will be applied to the videos to enhance their quality and appearance.
4. Payment and Pricing:
- No fee is required for participation in a videography portrait session or downloading one (1) video file.
- If additional video files are present in the provided gallery, they will be available for purchase at $35.00 per video file.
5. Delivery and Turnaround Time:
- Machmer Media will provide an estimated delivery date for the edited portraits, taking into account the complexity of the editing process and the company's current workload.
- Delays may occur due to unforeseen circumstances, such as technical issues or emergencies. In such cases, the participants will be notified promptly.
6. Reproduction and Distribution:
- The participants agree not to reproduce, distribute, or sell the portraits for commercial purposes without prior written consent from Machmer Media.
- Machmer Media reserves the right to use images of the portraits for promotional purposes, unless otherwise specified by the participants, parents, or legal guardians.
7. Cancellation and Refunds:
- If a participant has signed up for a videography session, they may cancel their signup at any time.
8. Liability:
- Machmer Media is not liable for any damage, loss, or injury resulting from the videography session or the use of the media deliverables.
- The participants, parents, and legal guardians agree to indemnify and hold harmless Machmer Media from any claims or disputes arising from the videography session or the use of the media deliverables.
9. Governing Law:
- These terms and conditions shall be governed by and construed in accordance with the laws of Colorado. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Larimer County.
By signing up for or by participating in a videography session with Machmer Media, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. If you have any questions or concerns, please contact Machmer Media before proceeding with your session.
